By accessing our website, interacting with our digital terminal, or purchasing our premium apparel, you ("user," "customer," or "you") agree to be bound by the following Terms of Service ("Terms"). Please read these Terms carefully before compiling any transactions. If you do not agree to all the terms and conditions of this agreement, you must immediately terminate your session and cease using our platform.

1. Account Terms

  • Account Security: If you create a user account on our platform, you are entirely responsible for maintaining the confidentiality of your account credentials, passwords, and restricting unauthorized access to your device.

  • Data Accuracy: You agree to provide current, complete, and accurate purchase and account information for all transactions made at our store. We reserve the right to terminate accounts or refuse service instantly if any information provided is found to be false, inaccurate, or misleading.

2. Pricing and Payment

  • Currency: All prices displayed on our storefront are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless explicitly stated otherwise.

  • Price Adjustments: We reserve the right to alter product prices, modify configurations, or discontinue designs at any moment without prior notification.

  • Payment Protocols: We utilize secure, RBI-authorized, third-party payment gateways to process transactions. By completing a purchase, you authorize us (and our processors) to charge the designated amount to your chosen payment method (UPI, Debit/Credit Card, Net Banking). We do not store your raw banking or credit card credentials.

  • COD Terms: For Cash on Delivery (COD) orders, you agree to pay the full invoice amount in cash or digital wallet link to the courier partner upon physical delivery. Repeated rejection of COD orders may result in your account being blacklisted from future purchases.

3. Product Descriptions and Accuracy

  • Visual Representation: We make every effort to display the colors, textures, and details of our premium 240 GSM apparel as accurately as possible on screen. However, because digital screen calibrations vary, we cannot guarantee that your monitor's display of any color will be 100% identical to the physical fabric.

  • Sizing: Our garments generally follow a specific oversized, boxy streetwear silhouette. It is your responsibility to consult our official Sizing Chart prior to placing an order.

  • Errors and Omissions: Occasionally, information on our Store may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, and stock availability. We reserve the right to correct any errors and to change or update information at any time without prior notice.

4. Order Acceptance and Cancellation

  • Verification: The receipt of an email order confirmation does not constitute our final acceptance of an order. We reserve the right, at our sole discretion, to refuse, limit, or cancel any order for any reason.

  • Cancellation Triggers: Reasons for order cancellation may include, but are not limited to: limitations on available stock, inaccuracies or errors in product or pricing information, or flags raised by our automated credit and fraud avoidance systems.

  • Refunds on Cancellation: If your order is canceled by our system after your payment has been successfully processed, we will execute a complete refund back to your original payment method within standard banking timelines.

5. Shipping and Delivery

  • Logistics: We partner with domestic third-party courier services to ship packages across India.

  • Timelines: Estimated delivery timelines are provided for logistical context only and are not absolute guarantees. We are not liable for delayed deliveries resulting from courier constraints, extreme weather, statutory holidays, or regional enforcement protocols.

  • Transfer of Risk: Title and risk of loss for all physical items pass to you upon our delivery of the package to the carrier service.

6. Returns and Refunds

  • All purchases made through our platform are governed by our official Return and Refund Policy. Please review that document to understand active timeframes, product eligibility standards, and processing parameters.

7. Prohibited Uses

In addition to other boundaries set forth in these Terms, you are strictly prohibited from using the platform or its content:

  • For any unlawful, fraudulent, or malicious purpose violating central, state, or international Indian statutes.

  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others (including cloning, scraping, copying, or duplicating our unique technical graphic designs).

  • To upload or transmit viruses, malware, or any other type of malicious code that will or may be used in any way to compromise the security or functionality of the Service.

  • To collect, track, or harvest the personal data of other store users.

8. Limitation of Liability

  • Disclaimer: Our Store and all products delivered to you through the service are provided on an 'as is' and 'as available' basis for your use, without any representation, warranties, or conditions of any kind, either express or implied.

  • Liability Ceiling: In no case shall The Ctrl Z, our directors, officers, employees, or partners be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind—including lost profits, lost revenue, or data loss—arising from your use of the service or any products procured using the platform. Our total cumulative liability to you shall not exceed the actual purchase amount paid by you for the specific product causing the dispute.

9. Governing Law and Jurisdiction

  • These Terms of Service and any separate agreements whereby we provide you Services shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India.

  • Any legal disputes, claims, or system conflicts arising out of or in connection with these Terms, or your transactions on our platform, shall be subject to the exclusive jurisdiction of the courts located in Haldia, India.

  • We reserve the right to update, modify, or rewrite any part of these Terms of Service by posting updates directly to our website terminal. It is your responsibility to check our platform periodically for changes. Your continued use of or access to the website following the posting of any modifications constitutes active acceptance of those changes.
